On Jun. 30th, Mississippi State Representative Fabian Nelson filed a motion in federal court seeking permission to submit an amicus curiae or “friend of the court,” brief in the litigation over the governance of Jackson-Medgar Wiley Evers International Airport. Appearing in his individual capacity, Nelson said the filing is intended to provide the court with the perspective of a sitting member of the Mississippi Legislature on the constitutional issues raised in the case. According to Nelson, the proposed brief focuses on the constitutional limits of legislative authority under the Fourteenth Amendment, the role of judicial review and the potential impact the court’s decision could have on future relationships between the State of Mississippi, municipalities, and public authorities. The motion was filed as the bench trial entered its final stages. Today, attorneys for both the plaintiffs and the state will present closing arguments, concluding the trial.
