Matthew Wilson, attorney for David L. Archie, issued the following statement regarding the Supreme Court of Mississippi’s dismissal of Anthony “Tony” Smith’s appeal
On November 13th, the Supreme Court of Mississippi granted David L. Archie’s motion to dismiss Tony Smith’s appeal for lack of jurisdiction.
On August 27, 2025, the Hinds County Circuit Court ruled that Mr. Archie timely filed his petition seeking judicial review of the 2023 Democratic primary for Hinds County Supervisor (District 2).
On September 5, 2025, Tony Smith noticed his appeal to the Supreme Court of Mississippi.
Recognizing that Mr. Smith’s notice of appeal was fatally defective, David L. Archie moved the Supreme Court of Mississippi to dismiss the appeal on September 25, 2025.
Mr. Archie’s argument was so compelling that Mr. Smith did not even bother to respond. As a result, the Supreme Court of Mississippi dismissed Tony Smith’s frivolous appeal today (Nov. 13th).
This means that the matter will return to the Circuit Court for full discovery and for a hearing on the merits.
As a result, the people of Mississippi will finally learn in full detail about the radical departure from election laws and the gross irregularities that occurred during the 2023 Hinds County Democratic Primary.
This is the second time on this case that David L. Archie has appeared before the Supreme Court of Mississippi and won. Both times Mr. Archie has overcome Mr. Smith’s attempts to delay this matter.
